Your use of the RentaBackpack Inc’s website constitutes your agreement to follow and be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use this site or rent any products from Rentabackpack Inc.

Rental Policies

Cancellation Policy

~ You can cancel your backpack rental packages and/or bearspray rentals up to 48 hours before your rental start date and receive a FULL REFUND.  

~ If you cancel less than 48 hours of your agreed upon rental start date or do not show up for your pick-up, a $20 plus GST administrative fee per pack will be withheld from your refund.

Money Back Guarantee

In the unlikely case you are not satisfied with our service or equipment, we offer a 100% money back guarantee.  You will be eligible for a full refund on the method you used at checkout within 24 hours of your equipment return date.  

Credit Card Authorization

Subject to such limitations as may be set forth in applicable law, You irrevocably and unconditionally authorize RentaBackpack Inc. to immediately submit for payment on the credit card You the “Renter” have provided RentaBackpack Inc. all estimated charges coming due under this RentaBackpack Inc’s Terms and Conditions Rental Agreement, and You the “Renter” agree to indemnify, defend and hold harmless RentaBackpack Inc. with respect to the same.

Security Deposit

You agree that RentaBackpack Inc. can deduct any amount deemed owed from your agreed upon Security Damage Deposit of $250.00 for a Backpack rental, $75 for a Bear Spray rental and $40 for Ice Cleats rental that will be charged 24 hours prior to the gear drop off date you have provided.  However, the amount of the deposit is not a limit of your responsibility or liability for the Backpack(s)/Equipment if damage or loss exceed your Security Deposit. You are also not entitled to interest on the Security Deposit. 

Return of Security Deposit

All rental equipment charges are subject to an additional “Security Damage Deposit Fee” of $250.00 to cover late return charges and excessive equipment damage or loss.  This deposit will be returned - in full - via the payment method used at checkout if the equipment is not damaged, lost, and returned prior to or on the agreed upon time by the “Renter”.

Terms of Rental Agreement

As a “Renter” of RentaBackpack Inc’s backpacks and equipment, you show proof of age and be at least 19+ years of age and are agreeing to Our Terms and Conditions in the Terms of Rental Agreement Waiver Form which you MUST SIGN via e-signature or in-person and acknowleged prior to receiving your backpacks and equipment:

Damaged, Dirty, Lost or Stolen Backpack/Equipment

Everyone at RentaBackpack Inc. have 25+ years of experience using the backpack equipment that we rent out.  So we understand what “normal” wear and tear means on a day to day or season to season basis. So, if we deem any tears, stains, breaks, bent trekking poles, missing parts, etc. is “excessive” and not “normal” wear and tear, RentaBackpack Inc. Reserves the Right to have any repairs or equipment replacement costs charged back to YOU, the Renter.  

~ If the equipment is damaged, the cost of the repair or replacement will be deducted from the deposit.   

~ If the equipment is lost or stolen or not returned for any reason, 100% of the damage deposit will not be returned PLUS any additional equipment replacement costs will be charged to your Credit Card.

~ If the backpack and equipment are excessively dirty upon return, RentaBackpack Inc. may charge you a cleaning fee of $50.00 per backpack rental. You consent to allowing RentaBackpack Inc. to automatically charge the credit card used in making your reservation. If such payment does not go through, you must pay the cleaning fee within five business days from receiving notice from RentaBackpack Inc.

Late Returning Your BackPack & Equipment?

At the time of the rental, you have agreed to a pick-up time for the Backpack(s) and Equipment to be placed back in the plastic tub(s) and ready for RentaBackpack Inc. staff to pick up. If the Backpack & Equipment is not available upon the agreed upon pick up time, RentaBackpack Inc. reserves the right to charge You the Renter an additional full day's rental rate for each day the equipment is returned late.

Terms of Service

Disclaimer of Warranties / Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You expressly agree that your use of, or inability to use, the service and products are at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Rentabackpack Inc., its owners, employees, affiliates, agents, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Idemnification

You agree to indemnify, defend and hold harmless Rentabackpack Inc. and owners, employees, partners, agents, contractors, licensors, service providers or suppliers,harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or Rental Agreement Waiver Forms in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Bear Spray Policy

~ The owners of RentaBackpack Inc. have hiked thousands of Kilometers over 25+ years and have encountered many bears, but have NEVER had to deploy our Bear Spray. So, the likelyhood of you having to actually deploy the spray is remote/rare. If your bear spray is sprayed or damaged for any reason, this will result in a $75 charge to be deducted from the “Renters” damage deposit. All bear spray cannisters will be weighed upon return, so we’ll know if they have been deployed.

~ Never discharge your bear spray for any other reason than its intended purpose.

~ DO NOT use Bear Spray like its a bug spray! Sadly, each year, someone misunderstands how to use bear spray. Don’t be that person. As part of your Rental Agreement, you must go to Bear Info to learn how to properly use Bear Spray.

~ Photo ID and a Credit Card is required prior to or at dropoff for security deposit. Renter must be an adult (19+) years of age. 

Delivery Policy

All backpacks & equipment will be delivered to the location & time specified at checkout, unless specified otherwise.  If YOU the “Renter” are not able to receive the equipment in-person, alternate arrangements MUST be made for someone else to receive the backpack & equipment.  This would include, Hotel Concierge, BNB Host, or a pre-arranged third party person to accept the backpack & equipment at the pre-arranged location/time. 

~ By renting the backpack(s) and equipment, you acknowledge that you are responsible for any third party to receive the Backpack(s) & Equipment and assume all the risks & liabilities associated with it. 

*Note, if YOU the “Renter” are not at the agreed location and drop off time, nor has alternate arrangements been made with a third party to leave the backpacks & equipment with, Rentabackpack Inc. reserves the right to cancel your rental and charge a $25 administrative fee per backpack rental.    

Terms of Delivery

This is what YOU the ‘Renter’ agree to and what your responsibilities start date and end date are when renting from RentaBackpack Inc. and are subject to the following delivery terms and conditions:

Start Date

Your start date with regards to liability is the day & time you actually receive the backpack(s) & equipment. Your gear will arrive the day before you plan on hiking in a sealed marked plastic tub. Unless otherwise agreed upon, drop off will occur between 5:00pm - 8:00pm.

Return Date

Your return date is the day and time after your hike where you place the backpack(s) and equipment back in the supplied plastic tub(s) for pick up. Unless otherwise agreed upon, pick-up will occur between 7:00am - 10:00am. You the “Renter” are responsible for any losses or damage until employees of RentaBackpack Inc. picks up the Backpack(s) and equipment.

Understanding the length & responsibilities of your Rental Period

For example, if your hike is on a Saturday and you plan on returning the backpack(s) & equipment on a Sunday, we consider that a 3 day ‘rental liability period’. The backpack(s) & equipment would be dropped off on the Friday evening and picked up on the Sunday morning. But you would only be charged for 1 day.

~ Please Note: You, the Renter are 100 % responsible for the loss or damage to the backpack & equipment from the moment it is dropped off to the moment they are picked up.

Backpack & Equipment Product Use

You, the “Renter” assumes all risks when in possession of all products & equipment provided from RentaBackpack Inc., including any risk of defect or personal harm arising out of the use of, or inability to use the products & equipment. RentaBackpack Inc. is not liable for any damages or personal harm including but not limited to direct, incidental, consequential, or indirect damages or personal harm arising from the use of RentaBackpack Inc’s products & equipment or information on this web site.

All products & equipment from RentaBackpack Inc. are to be used solely for legitimate hiking activities & outdoor safety purposes. Any other use is strictly prohibited by Canadian & Provincial law. YOU the Renter and all users of the equipment must be 21 years of age or older and is solely responsible for the safe and lawful handling, deployment and storage of all products & equipment during the duration of their rental liability period. RentaBackpack Inc. shall not be responsible for any injury or damage resulting from the use or handling of these products or equipment, whether or not they are used in accordance with the above stipulations.

YOUR GENERAL RESPONSIBILITIES

You are responsible for the following:

~ Reading and complying with all Terms of Service policies and rules provided by RentaBackpack Inc.

~ Signing and agreeing to all Terms in the Rental Agreement Waiver Forms

~ Only using the equipment for recreational purposes

~ Only using the equipment for its intended purpose(s)

~ Ensuring that all your activity abides by all applicable local, provincial, national and foreign laws, treaties and regulations

~ Ensuring that all persons who utilize the backpack(s) and equipment are aware of these Terms of Use and comply with them

~ Taking precautions to safeguard the backpack(s) and equipment from theft

~ Immediately reporting to RentaBackpack Inc. any damage to the backpack & equipment or any breach of these Terms of Use

~ Immediately reporting any missing parts when the backpack(s) & equipment arrives, if backpack(s) & equipment are not reported missing you will be charged for any missing parts upon return
